Do I need a workers compensation lawyer?
You can make a workers compensation claim without using a workers compensation lawyer. However, every workers compensation claim is different, and it can be hard to know if you’re getting everything you’re entitled to. It’s also common for insurers to deny part or all of a compensation claim. Our workers compensation lawyers can review your claim and make sure you receive your full entitlements. What will a workers compensation lawyer cost me?

How much compensation will I get?
The following table summarises the weekly workers compensation payments in NSW you may be eligible to claim for injuries that have occurred after 21 October, 2019:

*Able to return to suitable employment but not pre-injury employment.
The maximum weekly compensation amount is capped and indexed in April and October each year.
The maximum amount from 1 October 2024 to 31 March 2025 is $2,523.00.
What if my workers compensation claim has been denied?
If your workers compensation claim is denied, there are options open to you to dispute the decision. The insurer that has denied your claim must notify you in writing of their reasons for the denial and provide information on the next steps available to you.
Here are some examples of common disputes:
- The insurer doesn’t consider the person making the claim to be a ‘worker’ (under the legislation).
- The insurer considers that employment wasn’t the main contributing factor to the injury.
- It wasn’t ‘reasonably necessary’ to have the medical treatment or to incur other expenses claimed.
- The insurer has blamed your mental health condition on your transfer, demotion, promotion, performance appraisal, discipline, retrenchment or dismissal or provision of employment benefits.
- The insurer is of the view that your employer’s actions were reasonable.
On 1 March 2021, the Personal Injury Commission (PIC) became the central body for resolving all workers compensation disputes.
If you have a dispute with an insurer, here are some options:
- Request an internal review by the insurer, who must respond within 14 days.
- Lodge a dispute directly with the PIC.

Can I claim a lump sum workers compensation payout?
There are two ways you can get a workers compensation lump sum settlement:

How long does it take to get my compensation?
After your claim is submitted by your employer, the insurer has 14 days to notify you whether:
- Your claim is accepted
- There’s not enough information to make a decision and they need more time
- Your claim is denied
If your claim is accepted, you should start receiving payments straight away
How long do I have to submit my workers compensation claim?
Workers compensation claims in NSW should be made within six months of becoming aware of your injury. However, there are exceptions where you can exceed this time limit. For example:
- A claim can be made up to three years after the injury in some situations (e.g. if you’ve been travelling or you make an honest mistake).
- If a claim relates to serious and permanent impairment, the claim may still be made after three years, if there’s a reasonable cause for the delay.
- If a period greater than three years has passed since the accident then a claim may still be made with SIRA approval.
There are also special arrangements if you become aware of an injury a long time after it happened. In these cases, the time limit for workers compensation claims starts from the time you become aware of your injury and the reasons for it.
