Workers Compensation claim advice.

You can make a workers compensation claim without using a workers compensation lawyer. However, every workers compensation claim is different, and it can be hard to know if you’re getting everything you’re entitled to. It’s also common for insurers to deny part or all of a compensation claim. Our workers compensation lawyers can review your claim and make sure you receive your full entitlements. If you find yourself in a dispute with an insurer, having a lawyer on your side will give you a much better chance of success.

Even if your case seems straightforward, getting the right legal advice could uncover additional benefits. To learn more, check out our guide Workers Compensation Legal Advice – Our Top Five Tips.

We’ll provide you with free advice, and if you decide to proceed with your claim the workers compensation insurer is responsible for paying your legal costs at the end of your case.

If we find that you’re entitled to Permanent Impairment or Work Injury Damages lump sum payments, we’ll work on a no win no fee, no disbursements basis, so you’ll only need to pay our fees if we win, and you receive your lump sum compensation.

The following table summarises the weekly workers compensation payments in NSW you may be eligible to claim for injuries that have occurred after 21 October, 2019:

If your workers compensation claim is denied, there are options open to you to dispute the decision. The insurer that has denied your claim must notify you in writing of their reasons for the denial and provide information on the next steps available to you.

Here are some examples of common disputes:

  • The insurer doesn’t consider the person making the claim to be a ‘worker’ (under the legislation).
  • The insurer considers that employment wasn’t the main contributing factor to the injury.
  • It wasn’t ‘reasonably necessary’ to have the medical treatment or to incur other expenses claimed.
  • The insurer has blamed your mental health condition on your transfer, demotion, promotion, performance appraisal, discipline, retrenchment or dismissal or provision of employment benefits.
  • The insurer is of the view that your employer’s actions were reasonable.

On 1 March 2021, the Personal Injury Commission (PIC) became the central body for resolving all workers compensation disputes.

If you have a dispute with an insurer, here are some options:

  • Request an internal review by the insurer, who must respond within 14 days.
  • Lodge a dispute directly with the PIC.
  • Contact us on 0292644474 and ask for free legal advice – it may be possible to get legal representation at no cost to you.

There are two ways you can get a workers compensation lump sum settlement:

Payout Description
Permanent impairment payout

A lump sum compensation payout to cover a permanent impairment as a result of a work-related injury or illness.

Work injury damages payout

Also known as common law claim, this is a lump sum payout for damages if your injury was caused by your employer’s negligence.

To learn more about permanent impairment lump sum payments, you can refer to our whole person impairment compensation calculator and guide

To find out if you qualify for a work injury damages payout, you can call 0292644474 and get free legal advice from a workers compensation lawyer.

After your claim is submitted by your employer, the insurer has 14 days to notify you whether:

  • Your claim is accepted
  • There’s not enough information to make a decision and they need more time
  • Your claim is denied

If your claim is accepted, you should start receiving payments straight away

Workers compensation claims in NSW should be made within six months of becoming aware of your injury. However, there are exceptions where you can exceed this time limit. For example:

  • A claim can be made up to three years after the injury in some situations (e.g. if you’ve been travelling or you make an honest mistake).
  • If a claim relates to serious and permanent impairment, the claim may still be made after three years, if there’s a reasonable cause for the delay.
  • If a period greater than three years has passed since the accident then a claim may still be made with SIRA approval.

There are also special arrangements if you become aware of an injury a long time after it happened. In these cases, the time limit for workers compensation claims starts from the time you become aware of your injury and the reasons for it.

Domenique is so lovely, patient and understanding. Her advice is clear, supportive and encouraging. Even her voice is calming! I am so grateful to have found Law Partners and that I got a no-bias, no-judgement treatment from Domenique, which I am hopeful to have from her colleagues as well. Thank you very much, and all the best!

Greetings, I’m Usman. In 2019, I experienced an accident while under workers comp. Over the span of four years, Mimi, Caitlin, and Yasmine from the Law Partners team provided invaluable assistance in navigating my dealings with Icare. Their support led to an exceptional experience, securing all necessary approvals, including surgeries. Subsequently, Minaa, Vicky, and Sakeena from CTP facilitated an outstanding outcome with my claim, displaying consistently prompt responses and diligent pursuit of every matter. Overall, I couldn’t recommend a better company. Learn from my experience: before initiating any claim or filling out any form, consult with Law Partners. This is where I made mistakes by downplaying my injuries.

I truly can’t thank the team at Law Partners enough. The amazing work that Jennifer and her team and Elyse and her team are doing for me is appreciated beyond what I can convey here in a short review.

The friendly, thorough and professional manner in which they’ve all approached my case has helped me tremendously during this difficult period in my life.

I had a Bullying & Harassment claim Appeal. Fernanda and her support team were absolutely amazing. So very professional and compassionate as it was a very daunting process. They were able to reverse the decision in my favour. I would thoroughly recommend them to anyone with a Workers Compensation claim.

My husband has been going through a grueling workers compensation claim and the one saving grace throughout this horrible process has been the wonderful support from Haider and his team at Law Partners. They are quick to respond to any and every inquiry or concern we have, and have stood up to the insurer multiple times on our behalf, with very favourable results. When the government announced its intention to introduce reforms to the Workers Compensation Act earlier this year, Haider was very quick to call us personally and inform us of how we may be affected if the reforms went through, and began expediting our claim as much as he could to ensure we had the best possible outcome. This level of care (which I’m sure he provided to all of his clients) went above and beyond expectations and as a result it looks as though we’ll be able to finish this process earlier than previously expected, which is a huge relief. I don’t know where my family and I would be without the wonderful legal support we have received, and I can’t thank Haider and his team enough.

What can I say? Absolutely amazing support and results from Lydia and her team at Law Partners. Dealing with an accident claim since 2019 and have had nothing but the best service.

I’d like to thank Lydia and the team for going above and beyond through the whole process of the claim. This will definitely help with the process of getting back on track with life after a traumatic accident.

Thank you again.
