What lifting and back injuries can I claim for in NSW?

We’re here to help you claim compensation for your back injury at work, or any other injury caused by lifting at work.

Lower back strain.

Repeated heavy lifting or a sudden awkward movement can strain back muscles and spinal ligaments.

Rotator cuff strains and tears.

Rotator cuff injuries can develop over time through repetitive activities or can result from a sudden lifting motion or a fall onto an outstretched arm.

Bulging or ruptured discs.

Lifting can cause the soft material inside discs (the cushions between vertebrae) to bulge or rupture and press on a nerve.

Muscle strains.

Generally caused by excessive muscle stress from lifting or irregular physical actions, resulting in a tear to the muscle fibres.

What can I claim for a lifting or back injury in NSW?

The amount of compensation you can claim for a lifting or back injury at work depends on your whole person impairment (WPI) assessment. Here’s a summary of NSW entitlements:

Workers Compensation Payment NSW:
Weekly payments

These are payments to compensate you for lost income while you’re off work.

Medical expenses

Payment of your medical, hospital, ambulance, rehabilitation (including home help) and travel expenses.

Permanent impairment payout

A lump sum compensation payout to cover permanent impairment as a result of work-related injury or illness.

Work Injury Damages payout

Also known as common law claim, this is a lump sum payout for damages if your injury was caused by your employer’s negligence.

To qualify for a permanent impairment lump sum for a lifting or back injury, you’ll need to be assessed as having a WPI of 11% or more. Our specialist workers compensation lawyers can make sure your assessment is done correctly and that you receive your full back injury compensation entitlements, including any lump sums you’re eligible for.

How our NSW back injury lawyers can help you.

Here are four ways our workers compensation lawyers can get more compensation for your injury:

Dispute the workers compensation insurer’s decision if they’ve denied any part of your claim or any treatment.

Check your WPI assessment to see if you qualify for a permanent impairment lump sum payment.

Investigate the circumstances of your injury to determine if there are other claims you can make, such as a lump sum damages claim.

If you’re unable to work, we can review your superannuation policies to see if you’re entitled to a TPD lump sum.

Lifting and back injury claim FAQs.

You can make a claim without using a workers compensation lawyer. However, every workers compensation claim is different, and it can be hard to know if you’re getting everything you’re entitled to. It’s also common for insurers to deny part or all of a compensation claim. Our workers compensation lawyers can review your claim and make sure you receive your full entitlements. We’ll also apply to the IRO (Independent Review office) on your behalf for funding, so that you don’t need to pay our legal fees.

If you find yourself in a dispute with an insurer, having a lawyer on your side will give you a much better chance of success.

After your claim is submitted by your employer, the insurer has 14 days to notify you whether:

  • Your claim is accepted
  • There’s not enough information to make a decision and they need more time
  • Your claim is denied

If your claim is accepted, you should start receiving payments straight away.

If you’ve made a workers compensation claim, your employer can’t legally terminate you within the first six months after your injury purely because you’re unfit to resume work.

In NSW, an employer can only terminate an injured worker six months after the date of injury if they’ve met all their obligations to you. But even so, under the NSW Workers Compensation Act, you would still be eligible to benefits and there are still avenues for reinstatement.

Yes, if you’re a casual employee injured at work in NSW, you’re entitled to claim workers compensation. Workers compensation for casual employees is not only limited to citizens and permanent residents. If you’re on a visa that permits you to work in Australia and you’re injured at work, you’re still eligible to claim workers compensation benefits.

I was reluctant at first to put a claim in but I contacted Law Partners and was called back by Elyse to have a chat. From that moment on, Elyse, Brooke & Sarah have been brilliant. They have answered all my questions straight away, explained everything in detail, given me all the different options available and in the end, resolved my matter with a positive outcome. It has been a very pleasant experience working with them and I would gladly recommend Law Partners, Elyse and her team. Thank you!

My husband has been going through a grueling workers compensation claim and the one saving grace throughout this horrible process has been the wonderful support from Haider and his team at Law Partners. They are quick to respond to any and every inquiry or concern we have, and have stood up to the insurer multiple times on our behalf, with very favourable results. When the government announced its intention to introduce reforms to the Workers Compensation Act earlier this year, Haider was very quick to call us personally and inform us of how we may be affected if the reforms went through, and began expediting our claim as much as he could to ensure we had the best possible outcome. This level of care (which I’m sure he provided to all of his clients) went above and beyond expectations and as a result it looks as though we’ll be able to finish this process earlier than previously expected, which is a huge relief. I don’t know where my family and I would be without the wonderful legal support we have received, and I can’t thank Haider and his team enough.

I moved from another firm to Law Partners and right from the start it was a totally different experience. My solicitor Sarah King and her paralegal Cassandra Hughes were empathetic, encouraging and highly attentive.
I received regular updates, they sought to clarify issues as they arose,
They prepared for each new step and checked in with me after each new event in the process.
They turned a scary experience into an ok experience with a positive outcome.
I cannot recommend them enough.
Thank you thank you.

I have been very fortunate to have picked a team which shows professionalism and caring about a very personal matter giving always there time even out of the working hours to care about someone and show that it’s more than just a matter.

They have made my problem much more easier to deal with and have shown me the respect in continuous follow-ups to make me understand and deal with this matter in a much easier way without Angy and Chantille it would be very hard road to take. Thank you for caring and thank you for making me feel important in such a hard situation.

OUTSTANDING!

I would like to take this opportunity to thank very much Shifa and Xanthe for their hard work.

In this really stressful time for me the way I have been kept informed and have been explained the different steps has been amazing. The patience and understanding you also shown is way more than I could have asked for.

It’s hard for me really to put into words how much I appreciate and respect the both of you.

Thank you so very much!

First of all I would like to thanks Minaa, Vicky and Sakeena for guiding me through all the process of claim without any hassle. Although my claim was quite bit tough as I don’t have recollection of the accident, they manage to find out all the relevant evidence in order to dispute the insurer decision claiming me as fault. Their advice and guidance throughout the process always make me more comfortable and confidence to get the best possible outcomes. Overall, I am totally satisfied with the outcome of the claim as the claim has been settled with more than my expected amount. All of the team members from Law Partners are cooperative so I wouldn’t hesitate to recommend law partners for anyone needing help with personal injury claims.
