If you’re injured in a car accident as a driver or passenger, you can claim compensation to cover your losses, even if you were at fault. Pedestrians, cyclists and motorcycle riders injured in accidents with cars can also claim.
You’ll need to submit your application for personal injury benefits within 28 days of the accident to get your wages back-paid to the accident date. The final deadline for your application is three months from the accident.
The CTP insurer of the vehicle that was mostly at fault will assess your claim, and your injuries will be classified as being threshold (minor) or above threshold based on a medical assessment. This classification has a major impact on your entitlements, and whether you can claim lump sums.
If important details about your injuries are overlooked, you could miss out on lump sums you’re entitled to, and these can be significant. We’ll match you with a specialist car accident lawyer, build a personal relationship with you and your family, and look beyond your obvious injuries to claim everything you’re entitled to. This can make a big difference to the amount of compensation you receive.

A no win no fee lawyer offers to run your case for you and only get paid when you win. If you choose the right lawyer, it’s an excellent option that allows you to pursue your claim without any risk, but it’s important to check the lawyer’s costs agreement to fully understand what’s covered. With some no win no fee lawyers you can still end up having to pay thousands of dollars in disbursements if your case is unsuccessful. This is because their no win no fee agreements cover their professional fees but not the costs they incur. At Law Partners, our no win no fee, no disbursements guarantee covers all our costs and disbursements as well as our professional fees, so you can pursue your claim with peace of mind.
You should make your car injury claim within 28 days to be eligible for income loss from the date of the accident. The final claim lodgement date is three months from the accident, although this can be extended in certain circumstances.
If your car accident compensation benefits are being cut off by the CTP insurer, there could be a few reasons why:
There are two steps you can take to dispute an insurer’s decision to cut off your benefits:
If you request an IIR, it means you disagree with the insurer’s decision to reduce or cut off your benefits and you’re asking them to review your case file again. The letter you receive from the insurer will outline their reasons for cutting you off. You need to address each one of these reasons in your request for an IIR.
In most circumstances you need to request an IIR before you can take your matter to the PIC. The PIC will assist in one of two ways:
Arrange an independent and binding decision by an expert assessor.
Facilitate the understanding of issues between insurer and injured persons to mutually resolve these disputes.
