What mental health conditions can you claim for in NSW?

There’s no complete “list” of what qualifies for a TPD mental illness claim in NSW. Depending on your insurance policy, the key is that your condition has stopped you from going back to your job or the work you’re qualified to do. Here are some common mental illness categories which may be eligible for a TPD claim:

Post-traumatic stress disorder (PTSD) is a serious mental health condition which may qualify for a TPD claim. It’s associated with exposure to traumatic events, often a reality of life for emergency services workers. If you’ve been diagnosed with PTSD and can’t return to work, you may be entitled to a TPD lump sum payout.

When depression is severe enough, it can dramatically impact a person’s cognitive, social and work abilities. We’ve looked after many successful TPD claims for clients with diagnosed depression, so reach out to our TPD claim specialists for help if you think you may qualify for a TPD insurance payout.

Mental health conditions that include anxiety, severe stress, anxiety attacks or panic attacks may all qualify for a TPD payout because they can seriously interfere with daily functioning and work capacity. Speak to one of our TPD claims specialists for free advice on your situation.

Depending on your condition’s severity, bipolar disorder can disrupt your ability to maintain employment due to the impact on cognitive, emotional and social functioning. The key is whether or not you can be treated and return to the work which suits your education, training or experience.

As a mental illness, a schizophrenia diagnosis can qualify for a TPD insurance payout when it prevents a person from working and is considered to be permanent. It’s considered a long-term condition and in certain cases, can have a severe impact on cognitive and social functioning. Speak to our TPD specialists for free advice on your situation.

TPD claim stories

Making a TPD claim changed my life.

Shannelle, Trevor and Regina, like so many injured Australians, were completely unaware that they were eligible to make a TPD claim before they contacted Law Partners. Watch the video to find out how a TPD payout changed their lives.

TPD mental health claim FAQs:

No, it doesn’t matter how your mental health condition originated – if it stops you from working, you may be eligible to make a TPD claim. And if your job caused your psychological injury, you might also be entitled to make a workers compensation claim.

It’s important to remember that some policies have specific exclusions, and you may not be able to claim for conditions that predate when your policy was taken out. If you’re not sure, it’s best to speak with one of our TPD specialists who can take a look at your policy and advise you about your specific situation, free of charge.

There’s no complete “list” of what qualifies for a TPD mental illness claim. Depending on your insurance policy, the key is that your mental illness has stopped you from going back to your job or stopped you from returning to the work you’re qualified to do. This might include mental health conditions such as PTSD, depression, anxiety, bipolar disorder, or schizophrenia.

For more examples of TPD claims, take a look at some of our TPD Claims Stories. The examples listed can be used as a general guide. However, you’ll need to check the criteria in your TPD insurance policy to understand exactly what you can claim for.

If you’re not sure whether you have TPD insurance cover, you can call Law Partners on 0292644474. With your permission, we’ll contact your super fund (or funds) on your behalf and find out what cover you have – there’s no cost for this service.

Yes, if you have more than one TPD policy, you may be able to make multiple TPD claims – one for each policy. This is quite a common situation, as many people have multiple superannuation funds as a result of changing jobs over the years and may have a TPD policy through each fund. Making a successful TPD super claim against one policy has no effect on any other TPD insurance you may have, but you’ll need to submit a separate claim against each policy.

It usually takes 6-12 months for a mental illness TPD claim to be finalised.

Insurance companies generally assess TPD claims within six months. Some straightforward claims are finalised sooner, however with more complicated claims insurance companies often take longer than six months to make a decision.

Once the insurance company has made its decision on a TPD claim, the trustee of the superannuation fund must make their own separate assessment. This process usually takes between one and two months.

This can vary, but TPD mental illness claim payout amounts typically range between $60,000 and $600,000, with many payouts being more than $200,000. The amount you can claim is called your ‘insured benefit amount’, and it will be identified on your superannuation member statement.

I was shocked when my initial assessment came back as minor but I was too overwhelmed at the time to dispute it. Something in my gut told me to get a second opinion and I’m so relieved I did. I almost missed out of a lump sum payment which has helped so much with my recovery.
