What common physical injuries can you claim for?

There’s no complete “list” of what qualifies for a TPD injury claim. Depending on your insurance policy, the key is that your injury has stopped you from going back to your job or the work you’re qualified to do.Here are some common physical injury categories which may be eligible for a TPD claim:

Conditions can commonly include fractured vertebrae, chronic sciatica, cauda equina syndrome, back injuries resulting in spinal fusion or paralysis, and degenerative disc disease, ruptured or herniated discs. We’ve also looked after TPD claims for clients following failed back surgeries that result in chronic and ongoing pain.

Loss of limb injuries are considered a serious condition that may qualify for a TPD claim. If you’ve suffered a loss of limb injury, you could be eligible for a payout. Common examples include loss of finger, hand, arm, foot, or leg injuries. A loss of ear injury may also be considered under the category of a specific loss or major physical impairment in many TPD policies.

These include neck injuries such as herniated discs requiring surgical intervention, and traumatic brain injuries including concussions, contusions, haematomas, and haemorrhages. We’ve also managed TPD claims for clients with fractured skull injuries, cuts or lacerations to the head requiring surgery with long-term effects on work, and spinal cord injuries affecting neck mobility and sensory functions.

These types of injuries can permanently affect your ability to return to work, and may qualify for a TPD claim. They could include industrial deafness from workplace settings, partial or full blindness or deafness resulting from an accident or medical condition, and brain injuries which cause a loss of speech.

Spinal cord injuries leading to paraplegia or quadriplegia are usually permanent, which often make them eligible for TPD claims. These physical injuries involve the complete and irreversible loss of the use of limbs, and can result in significant impairments that affect an individual’s ability to work.

Burns range in severity and can certainly affect your ability to return to work. Third-degree burns can be serious and require skin grafts and ongoing treatment, whereas fourth-degree burns can affect muscles, bones and lead to a permanent disability. Other conditions which may qualify include serious chemical, electrical and inhalation burns.

No, it doesn’t matter how your physical injury occurred – if it stops you from working, you may be eligible to make a TPD claim. If your injury happened while you were working, you might also be entitled to make a workers compensation claim.

It’s important to remember that some policies have specific exclusions, and you may not be able to claim for conditions that predate when your policy was taken out. If you’re not sure, it’s best to speak with one of our TPD specialists who can take a look at your policy and advise you about your specific situation, free of charge.

There’s no complete “list” of what qualifies for a TPD injury claim. Depending on your insurance policy, the key is that your injury has stopped you from going back to your job or stopped you from returning to the work you’re qualified to do. This might include serious physical injuries to any part of your body including your back, neck, head, torso, legs, feet, arms, hands and so on. It can also include severe burns, loss of limbs, and loss of speech, sight and hearing.

Yes, if you have more than one TPD policy, you may be able to make multiple TPD claims – one for each policy. This is quite a common situation, as many people have multiple superannuation funds as a result of changing jobs over the years and may have a TPD policy through each fund. Making a successful TPD super claim against one policy has no effect on any other TPD insurance you may have, but you’ll need to submit a separate claim against each policy.

It usually takes 6-12 months for a physical injury TPD claim to be finalised.

Insurance companies generally assess TPD claims within six months. Some straightforward claims are finalised sooner, however with more complicated claims insurance companies often take longer than six months to make a decision.

Once the insurance company has made its decision on a TPD claim, the trustee of the superannuation fund must make their own separate assessment. This process usually takes between one and two months.

TPD injury claim payout amounts typically range between $60,000 and $600,000, with many payouts being more than $200,000. The amount you can claim is called your ‘insured benefit amount’, and it will be identified on your superannuation member statement.
