What truck accident compensation can I claim?

Help you claim a lump sum settlement. If your injuries are above threshold and you weren’t at fault in the accident, it’s very likely you can claim a lump sum settlement, and these lump sums can be substantial.

If you were working when you were injured, you may need to lodge two or more claims to get all the compensation you’re entitled to.
To lodge your CTP claim:
- You’ll need a police event number – you can get this by calling 131 444 or going to a police station.
- Obtain a certificate of fitness from your doctor.
- Lodge an application for personal injury benefits on the CTP insurer of the vehicle mostly at fault for the accident.
- You have 28 days after the date of the accident to lodge this application to get back-payment for any lost wages.
- The final deadline for lodging your CTP claim is three months from the date of the accident.
- Note that this application doesn’t cover any lump sum payments you might be entitled to – you need to apply for these separately.
To lodge your workers compensation claim:
- First, you should report your injury to your employer.
- You’ll need to provide a certificate of capacity from your doctor.
- Your employer has 48 hours to report your injury to their workers compensation insurer.
- You can also report it directly to the insurer if you like.
- The insurer will contact you to arrange an assessment of your injuries and then notify you whether it’s accepting liability for your claim.
- It’s important to note that you don’t have to agree with the insurer’s decision, and you should seek legal advice if you have any concerns about it.
It’s strongly advised to get advice from a truck injury lawyer before you lodge your claim to make sure you’ve done it correctly and you get your full entitlement.
You can lodge your own compensation claims without using a lawyer. However, truck accident claims can be particularly complex, and it’s important to understand that if you leave out important details in your applications, or if your certificate of fitness isn’t completed correctly, it’s likely you’ll miss out on benefits you’re entitled to. - For CTP claims, the insurer will pay part of your legal fees for successful claims over $75,000, and all your legal fees for claims of $75,000 or below.
- For workers compensation claims, we can apply to the IRO for funding on your behalf to cover our fees, so there’s nothing for you to pay.
If you’re applying to the CTP insurer for a lump sum, there’s a schedule of regulated fees a lawyer can be paid to assist you for claims up to $75,000.
- These fees are paid by the insurer.
- If your settlement amount is greater than $75,000, the insurer will contribute to your fees. We’ll provide you with a schedule of these fees, set out in an agreement.
- This agreement is known as a “costs agreement”, and only applies to the amount we charge for your claim over the $75,000 threshold.
- The regulated fees still apply to the work we do for the first $75,000 of your claim and are still paid by the insurer.
