What work injury compensation can I claim?

If you’re injured at work in NSW and you make a work injury compensation claim, the following table outlines the weekly payments, medical expenses, and lump sum payouts you may be eligible to claim:

These are payments to compensate you for lost income while you’re off work.

Medical expenses

Payment of your medical, hospital, ambulance, rehabilitation (including home help) and travel expenses.

Permanent impairment payout

A lump sum compensation payout to cover permanent impairment as a result of work-related injury or illness.

Work Injury Damages payout

Also known as common law claim, this is a lump sum payout for damages if your injury was caused by your employer’s negligence.

Frequently asked questions.

If your claim is denied, there are options open to you to dispute the decision. The insurer that has denied your claim must notify you in writing of their reasons for the denial and provide information on the next steps available to you.

Here are some examples of common disputes:

  • The insurer doesn’t consider the person making the claim to be a ‘worker’ (under the legislation).
  • The insurer considers that employment wasn’t the main contributing factor to the injury.
  • It wasn’t ‘reasonably necessary’ to have the medical treatment or to incur other expenses claimed.

On 1 March 2021, the Personal Injury Commission (PIC) became the central body for resolving all work injury compensation disputes.

If you have a dispute with an insurer, here are some options:

  • Request an internal review by the insurer, who must respond within 14 days.
  • Lodge a dispute directly with the PIC.
  • Contact us on 13 15 15 and ask for free legal advice – it may be possible for you to get full legal representation at no cost to you.

The following table summarises the weekly workers compensation payments in NSW you may be eligible to claim for injuries that have occurred after 21 October, 2019:

The maximum weekly compensation amount is capped and indexed in April and October each year.

The maximum amount from 1 April 2022 to 30 September 2022 is $2,318.10.

If your injury at work is the result of negligence on the part of your employer, and you’ve been assessed as having a whole person impairment (WPI) of at least 15%, you can sue your employer for damages to cover loss of past wages and loss of future earnings capacity. This is a common law damages claim, and under the workers compensation system it’s known as a Work Injury Damages claim. If you’re considering suing for a work injury, you can call 13 15 15 for free legal advice on your options.

If you’ve made a workers compensation claim, your employer can’t legally terminate you within the first six months after your injury purely because you’re unfit to resume work.

In NSW, an employer can only terminate an injured worker six months after the date of injury if they’ve met all their obligations to you. But even so, under the NSW Workers Compensation Act, you would still be eligible to benefits and there are still avenues for reinstatement.

Yes, if you’re a casual employee injured at work in NSW, you’re entitled to claim workers compensation. Workers compensation for casual employees is not only limited to citizens and permanent residents. If you’re on a visa that permits you to work in Australia and you’re injured at work, you’re still eligible to claim workers compensation benefits.

Yes, but to be successful in your claim you need to prove two things:

  1. Your injury arose out of the course of your employment.
    This essentially means that the accident that caused the injury happened during work hours and at a place (home) which you were expected to be at in connection with your job. So as long as the accident happened during the agreed work hours and your employer approved you to work from home – then you would meet this requirement.
  1. Employment was a substantial contributing factor.
    To meet this requirement you need to prove that if you hadn’t been performing your work duties from home, the accident wouldn’t have occurred.
