Questions about claiming TPD in NSW? Start here.

TPD (total and permanent disability) is a type of insurance that provides you with a payment if you’re forced to stop work. When you make a TPD claim you’re claiming a lump sum payment on top of your superannuation fund balance.

If you’ve ever paid into a super fund, it’s likely you have TPD insurance connected to your super. If you’ve been off work for three or more months due to injury or illness, with no prospect of returning to work, then you may be eligible to make a TPD claim.

It can be hard to know how much TPD cover you have, as you may have multiple super funds and TPD policies from changing jobs over the years. If you can’t work and you’re not sure about your cover, you can call 0292644474 and we’ll find out for you. It’s a free service.

When claims are simply ‘processed’, important details can be missed. We’ll match you with a specialist TPD lawyer, build a personal relationship with you and your family, and look beyond your obvious injuries or illness to claim everything you’re entitled to. This can make a big difference to the amount of compensation you receive. Law Partners has TPD lawyers in Sydney and Melbourne ready to help.

Our NSW TPD specialists are here to help with your claim.

Critical illness.

Physical injury.

Has a permanent physical injury forced you to stop doing the work you’re qualified for? You might be eligible to make a TPD insurance claim.

Mental illness.

If a mental health condition such as PTSD, depression or anxiety is preventing you from working, you might be entitled to a TPD insurance payout.

How can I successfully claim TPD insurance in NSW?

It’s common for people to have their superannuation TPD claims rejected by insurers, or to abandon their claims when the claim process becomes difficult.

It’s important to note that the definition of TPD payout requirements can vary between policies – for example, your policy might cover you for:

  • Being unlikely to be able to return to work in your occupation
  • Being unlikely to be able to return to work in any occupation

A successful TPD claim needs to be backed by proof that you meet the criteria outlined in your TPD insurance policy. If the insurance assessor decides you don’t meet the criteria, your TPD claim will be rejected.

A successful TPD claim needs to be backed by proof that you meet the criteria outlined in your TPD insurance policy. If the insurance assessor decides you don’t meet the criteria, it’s likely your TPD claim will be rejected.

Claims are often rejected on the basis that the applicant doesn’t meet the criteria in the policy. However, in our experience, missing or incomplete information can be a major factor in these rejections.

In our experience, common reasons for insurers rejecting TPD insurance claims include:

  • Not meeting age restrictions
  • A dispute over the evidence provided
  • Not providing evidence that you meet the definition of disability in your policy
  • Lodging your claim too late
  • Your policy becoming inactive – this may be because you closed your account or the account has been inactive for some time
  • Applying before the minimum waiting period
  • Not meeting work history requirements

The time limit to lodge a TPD claim varies depending on the insurer and the specific policy. However, most superannuation policies require a waiting period before you can apply for a TPD benefit, which is typically three to six months from the date you ceased work due to your injury or illness.

In many cases, determining if there’s a time limit to lodge your claim can be difficult, so it’s best to speak with one of our TPD specialists and we’ll advise you about your specific situation, free of charge.

TPD claim stories

Making a TPD claim changed my life.

Shannelle, Trevor and Regina, like so many injured Australians, were completely unaware that they were eligible to make a TPD claim before they contacted Law Partners. Watch the video to find out how a TPD payout changed their lives.

TPD/Superannuation FAQs:

You can make your own claim without using a TPD claim lawyer. However, it’s common for people to have their TPD claims rejected by insurers because they fail to submit a thorough application, including all the documents and medical records needed to substantiate their claims. In other words, many people simply complete the application forms and assume their claim will be approved. But if you do that and fail to supply all the evidence needed to support your claim, it’s like the insurer will either reject your claim or keep asking you for more information, and the process can really drag on. This is why so many people who handle their own claims end up failing to get the TPD compensation they’re entitled to – they simply give up out of frustration.

A specialist TPD claim lawyer can compile all the evidence and submit your claim on your behalf, so the insurance assessor has all the information they need and you’re more likely to get your TPD claim approved.

No win, no fee lawyers offer to run your case for you and only get paid when you win. If you choose the right lawyer, it’s an excellent option that allows you to pursue your claim without any risk, but it’s important to check the lawyer’s costs agreement to fully understand what’s covered.

With some no win no fee lawyers you can still end up having to pay thousands of dollars in disbursements if your case is unsuccessful. This is because their no win no fee agreements cover their professional fees but not the costs they incur.

At Law Partners, our no win no fee, no disbursements guarantee covers all our costs and disbursements as well as our professional fees, so you can pursue your claim with peace of mind.

There’s no complete and defined “list” of common disabilities, injuries or illnesses that qualify you for a TPD claim. The key is that your condition has stopped you from returning to work.

Common examples fall under disability claims (such as blindness or loss of limbs), physical injuries (such as carpal tunnel or paraplegia), critical illness (such as multiple sclerosis or cancer), or mental illness (such as depression or PTSD).

For more examples of TPD claims, take a look at some of our TPD Claims Stories. The examples listed can be used as a general guide. However, you’ll need to check the criteria in your TPD insurance policy to understand exactly what you can claim for.

Yes, if you have more than one TPD policy, you may be able to make multiple TPD claims – one for each policy. This is quite a common situation, as many people have multiple superannuation funds as a result of changing jobs over the years and may have a TPD policy through each fund. Making a successful TPD super claim against one policy has no effect on any other TPD insurance you may have, but you’ll need to submit a separate claim against each policy.

To learn more on this topic, read our blog TPD Payouts – Your Complete Guide.

It usually takes 6-12 months for a TPD claim to be finalised.

Insurance companies generally assess TPD claims within six months. Some straightforward claims are finalised sooner, however with more complicated claims insurance companies often take longer than six months to make a decision.

Once the insurance company has made its decision on a TPD claim, the trustee of the superannuation fund must make their own separate assessment. This process usually takes between one and two months.

TPD payout amounts typically range between $60,000 and $600,000, with many payouts being more than $200,000. The amount you can claim is called your ‘insured benefit amount’, and it will be identified on your superannuation member statement.

TPD policy terms vary, and some policies allow you to retrain and return to work after paying you a lump sum benefit. So, the short answer is – there are some situations where you might return to work after a TPD payout.

A TPD payout is not classed as taxable income, but if you withdraw any part of your TPD payout from your super fund as a lump sum, you may have to pay “superannuation lump sum withdrawal tax”. The amount payable is different for everyone, and if you have multiple super funds, the amount will be different for each fund you make a withdrawal from.

Andrew and Kylie have been amazing, they always go above and beyond with their service. I was having a really bad time with my workers compensation claim. I was referred to Law Partners, they fought for my rights and made the insurance company accountable. I finally had my surgery which I needed to help me recover.

I look forward to working with them in the future on other aspects of my claim. This team really cares! You are not treated like a number… unlike the insurance companies.

Thanks to Law Partners for everything I feel safe and secure knowingly I can trust they are looking out for me always. Highly recommend for their professional, quick and responsive service. Like I said Exceptional Service!!!

Very satisfied with the outcome of my claim. Gillian, Melissa and all staff I dealt during my case were professional and caring and did an amazing job dealing with an insurance company to get me a fair compensation payout. So glad I chose Law Partners as otherwise, I would have given up in frustration and not been compensated for time lost at work due to someone else’s negligence. Recommend them highly.

I can’t thank the girls at law partners enough, I rang them as a last resort as I was struggling to get help from anyone else, after the first call I immediately felt better, they actually seemed like they cared, they immediately got the claim going, they organised all appointments & forms which made everything alot easier for me, when the compensation was offered they said it wasn’t adequate so they advised me to appeal the decision & I ended up getting double the original amount. Thanks again LawPartners!
