A more personal approach to your critical illness TPD claim.

If a terminal or critical illness has stopped you from working, a TPD (total and permanent disability) lump sum can provide much needed financial relief.

We’ve helped many people with critical illnesses make successful TPD claims, but we understand your situation is unique, and you’re different from every one of them. Getting you all of your entitlements starts with building a personal relationship with you, to truly understand your situation.

There’s no cost to speak to a TPD claim lawyer, tell your side of the story, and find out how much you can claim.

TPD claim stories

Making a TPD claim changed my life.

Shannelle, Trevor and Regina, like so many injured Australians, were completely unaware that they were eligible to make a TPD claim before they contacted Law Partners. Watch the video to find out how a TPD payout changed their lives.

Our TPD lawyers will get your claim approved ASAP.

We understand that when you’re faced with a critical or terminal illness, financial stress is the last thing you want to deal with. And we’re here to help.

A successful TPD claim needs to be backed by watertight proof that your illness meets the criteria in your policy. Our disability lawyers have made thousands of successful claims on behalf of our clients, and we have a network of hand-picked medico-legal specialists who work with us to build successful cases.

We’ll prepare your claim thoroughly and get your lump sum for you in the shortest possible timeframe.

What illnesses can I claim for?

Any illness that prevents you from returning to work could qualify for a TPD claim. Here are some examples of illnesses that could prevent you from working:

  • Cancer
  • Motor Neurone Disease
  • Multiple Sclerosis
  • Muscular Dystrophy
  • Dementia
  • Alzheimer’s Disease
  • Parkinson’s Disease
  • Chronic Lung Disease
  • Severe Rheumatoid Arthritis
  • Cardiomyopathy
  • Primary Pulmonary Hypertension

There’s no defined “list” of terminal illnesses and critical illnesses that are covered by TPD policies — but if you’ve developed an illness that has stopped you from returning to work, then it’s likely you’re covered under most TPD policy definitions.

When my husbands old TPD lawyer said she couldn’t help us anymore and closed our claim, Shane Butcher and Mark Saunders took on his claim and got my husband the money he was entitled to. Law Partners helped us through one of the most difficult times in our lives and we are very grateful.

After an injury that totally removed me from the workforce my future was bleak. I approached several Law companies receiving very little guidance, then I found Law Partners. With my settlement I keep my home and possessions and family intact. I also have good friends for life in the team at Law Partners.

I would like to take this opportunity to express my gratitude to my solicitor and the other Law Partners’ staff who assisted my children and myself since our car accident in 2012. I am certain that any positive and useful result would not have been achieved without your efforts, assistance and dedication to our cases.

Frequently asked questions.

Generally speaking, it takes 6-12 months for a TPD claim to be finalised.

Insurance companies generally assess TPD claims within six months. However, some critical illness claims can be finalised sooner. It’s only with more complicated claims that insurance companies tend to take longer than six months to make a decision.

Once the insurance company has made their decision on a TPD claim, the trustee of the superannuation fund must make their own separate assessment of the claim. This process usually takes between one and two months.

You can rest assured our critical and terminal illness lawyers will get your claim approved in the shortest possible time frame.

Some common reasons for insurers rejecting TPD insurance claims include:

  • Lodging your claim too late
  • Your policy becoming inactive – this may be because you closed your account, or the account has been inactive for some time
  • Not meeting the definition of disability in your policy
  • Applying before the minimum waiting period
  • Not meeting work history requirements
  • A dispute over the evidence you have provided
  • Not meeting age restrictions

If your TPD claim has been rejected, we can try to get the insurer’s decision reversed. For example, if your TPD claim was rejected because it was lodged too late, there might be circumstances beyond your control that caused the delay. Speak to one of our critical/ terminal illness lawyers to find out your options and whether we can get the insurer to reverse its decision.

If you’re not sure whether you have TPD insurance cover, you can call Law Partners on 13 15 15. With your permission, we’ll contact your super fund (or funds) on your behalf and find out what cover you have – there’s no cost for this service.
