What disabilities can you claim for in NSW?

There’s no complete “list” of what qualifies for a TPD disability claim in NSW. Depending on your insurance policy, the key is that your disability has stopped you from going back to your job, or the work you’re qualified to do. Here are some common disability categories which may be eligible for a TPD claim:

Loss of limb conditions are considered a serious disability that may qualify for a TPD claim. Common examples include loss of finger, hand, arm, foot, or leg injuries. A loss of ear injury may also be considered under the category of a specific loss or major physical impairment in many TPD policies.

When severe, carpal tunnel syndrome (CTS) can cause enough pain, numbness and weakness in a person’s hands or wrists, that makes it impossible to carry out work tasks. If you have CTS, speak to our TPD specialists for free advice on your situation.

Serious brain function impairment can result in conditions of cognitive decline, memory loss, or other neurological disorders. In situations like these, you may be entitled to a TPD payout, so speak to our specialist disability lawyers for free advice.

When chronic or recurrent pain is severe enough to prevent a person from performing their job duties at work, a TPD payout may be available. The key is persistent pain that limits your physical capabilities and affects your daily functioning. Our specialist TPD lawyers can offer you free advice.

Blackouts, including seizures or loss of consciousness, could make you eligible for a TPD insurance payout. The key is blackouts that are frequent and severe enough to prevent you from performing job duties safely and effectively, posing a risk to yourself or others.

TPD claim stories

Making a TPD claim changed my life.

Shannelle, Trevor and Regina, like so many injured Australians, were completely unaware that they were eligible to make a TPD claim before they contacted Law Partners. Watch the video to find out how a TPD payout changed their lives.

TPD disability FAQs:

No, it doesn’t matter what caused your disability – if it stops you from working, you may be eligible to make a TPD claim. And if your job caused your disability, you might also be entitled to make a workers compensation claim.

It’s important to remember that some policies have specific exclusions, and you may not be able to claim for conditions that predate when your policy was taken out. If you’re not sure, it’s best to speak with one of our TPD specialists who can take a look at your policy and advise you about your specific situation, free of charge.

There’s no complete “list” of what qualifies for a TPD disability claim. Depending on your insurance policy, the key is that your condition has stopped you from going back to your job or stopped you from returning to the work you’re qualified to do. This might include disabilities such as brain function impairment, loss of limbs, blackouts, or chronic pain conditions.

For more examples of TPD claims, take a look at some of our TPD Claims Stories. The examples listed can be used as a general guide. However, you’ll need to check the criteria in your TPD insurance policy to understand exactly what you can claim for.

If you’re not sure whether you have TPD insurance cover, you can call Law Partners on 0292644474. With your permission, we’ll contact your super fund (or funds) on your behalf and find out what cover you have – there’s no cost for this service.

Yes, if you have more than one TPD policy, you may be able to make multiple TPD claims – one for each policy. This is quite a common situation, as many people have multiple superannuation funds as a result of changing jobs over the years and may have a TPD policy through each fund. Making a successful TPD super claim against one policy has no effect on any other TPD insurance you may have, but you’ll need to submit a separate claim against each policy.

It usually takes 6-12 months for a disability TPD claim to be finalised.

Insurance companies generally assess TPD claims within six months. Some straightforward claims are finalised sooner, however with more complicated claims insurance companies often take longer than six months to make a decision.

Once the insurance company has made its decision on a TPD claim, the trustee of the superannuation fund must make their own separate assessment. This process usually takes between one and two months.

This can vary, but TPD disability claim payout amounts typically range between $60,000 and $600,000, with many payouts being more than $200,000. The amount you can claim is called your ‘insured benefit amount’, and it will be identified on your superannuation member statement.
