$1M payout provides relief after car crash nightmare for mum.
A single of mum of three has emerged from what she describes as the ‘darkest period of her life’ with a $1 million payout, following her successful CTP claim.
Layla, 55, with the guidance of Law Partners, received a lump sum payout for her pain and suffering, past and future economic loss and was even awarded domestic assistance for life after sustaining serious injuries in a car accident in May 2019.
“When the accident happened and before I called Law Partners, I never could have imagined a result like this – I didn’t even know I was entitled to lump sum compensation,” Layla admitted.
“But now, with my financial future secured, I can focus on my recovery and getting back to being the mother I want to be to my kids.”
Layla experienced chronic pain, her mental health significantly declined and she was consumed with feeling inadequate.
Layla, who also has a son with Cerebral Palsy, suffered a broken and dislocated arm, fractured disc in her lower back and multiple bruises and abrasions to her limbs and torso after her vehicle was slammed into by an out-of-control taxi hit by a runaway truck.
In the 10 months that followed, Layla underwent two major surgeries and experienced chronic pain, to the point where she struggled with work and simple household chores. Her mental health also declined and she was consumed with feeling inadequate.
Layla was so overwhelmed by her situation that her 20-year-old daughter, Raquel, dropped to part-time study and had to move back home to help her and the family get by. But a chance meeting with an old friend at the grocery store, would result in the much-needed change in fortune the family was looking for.
“We had no idea you could get a lump sum payout with your CTP claim. So we immediately Googled Law Partners and gave them a call.”
“I randomly bumped into a friend who asked about mum and how she was doing. After telling her, she then mentioned her uncle, who was involved in a serious motorcycle accident last year, and how his lawyers at Law Partners were incredibly helpful in getting him a lump sum payout for pain and suffering,” Raquel admitted.
“Up to that point, we had no idea you could get a lump sum payout with your CTP claim. So I immediately Googled Law Partners and convinced mum to give them a call.”
After meeting with Layla and carefully listening to her situation and understanding how the accident specifically impacted her life, Law Partners CTP specialist Ben, advised that she could be entitled to a lump sum payout – much to Layla’s surprise.
He explained that lump sum payouts in the CTP system are dependent on the level of permanent impairment from injuries. And anyone with more than 10 percent permanent impairment who was not at fault in an accident, would be entitled to a lump sum payout.
Ben gathered and assessed all the evidence from the accident, contacted the at-fault party’s CTP insurer and helped to arrange for a joint medical specialist to assess the Layla’s level of permanent impairment.
Accurately representing and articulating how Layla’s injuries impacted her life and ability to care for her disabled son, convinced the assessor to award the $1 million payout and domestic assistance for life.
The assessment determined that Layla sustained enough permanent physical impairment (12 percent) to qualify for lump sum compensation. But it was Ben’s ability to accurately represent and articulate how Layla’s injuries impacted her life and ability to care for her disabled son, that convinced the assessor to award the $1 million payout and domestic assistance for life.
The extraordinary result exceeded Layla’s wildest expectations and has provided clarity and security for her family going forward – something she describes as ‘priceless.’
“A compensation result like this gives me the greatest gift in the world – which is peace of mind in knowing that my family will be looked after in the future,” Layla said.
“I honestly can’t thank Ben, his team and Law Partners enough, not just for this incredible result but also for being a much-needed support network throughout the darkest period of my life.”
