Kelly’s Story.

TPD insurance is included in most superannuation policies and is there to provide you with a lump sum payment if you have an injury or illness that prevents you from working. However, TPD insurance claims can be stressful, as the definition of total and permanent disability varies between policies, so many of our clients who’ve tried to make a TPD claim on their own have come to us for help. Kelly’s story is a typical example of how our TPD lawyers can make a successful TPD claim for you and get you the maximum lump sum TPD payout.

Kelly was working as a deputy manager at a supermarket when she slipped on some ice in the freezer and fell backwards on the hard floor. Kelly sustained injuries to her back, neck, wrist and shoulder as a result of the accident. Due to the physical nature of Kelly’s role, she was forced to stop work immediately and focus on her recovery.

Getting to know Kelly and her family

When Kelly first came to Law Partners she was overwhelmed, concerned about her future and struggling with the financial burden. One of our specialist TPD lawyers met with Kelly to listen to her story and understand more about her accident and her injuries. Our team discovered that Kelly experiences chronic pain, is unable to stand for more than 10 minutes at a time and unable to sit or walk for more than 30 minutes at a time. She has pain when she lifts anything and has difficulty sleeping. Kelly was prescribed a comprehensive list of pain medications and developed fatigue, anxiety and depression. Kelly underwent surgery and numerous rehabilitation treatments and was able to return to work doing light duties, but unfortunately, she never returned to her normal duties as deputy manager and her employment was eventually terminated ‘due to incapacity’.

Kelly’s successful TPD claim

Kelly originally came to Law Partners seeking workers compensation. She had tried twice to submit TPD insurance claims herself and both claims were declined. Our TPD lawyers compiled detailed medico-legal reports and built a strong case for Kelly, and the TPD claim was successful. The lump sum TPD payout Kelly received on top of her workers compensation has made a huge difference to her life financially, as she continues to pursue treatment for her injury.

How can I make a successful TPD claim?

A TPD claim provides you with disability benefits under your superannuation policy paid in one lump sum. However, the definition of TPD varies between policies – for example, your policy might cover you for:

  • Being unlikely to be able to return to work in your occupation
  • Being unlikely to be able to return to work in any occupation

Successful TPD insurance claims need to be backed by proof that you meet the criteria outlined in your TPD insurance policy. If the insurance assessor deems that you don’t meet the criteria, your TPD claim will be rejected. Our specialist TPD lawyers have made thousands of successful claims on behalf of our clients, and we have a network of hand-picked medico-legal specialist who work with us to build successful cases. It makes sense to get legal advice as soon as possible, before you proceed with a TPD claim. You can call us and speak to one of our specialist TPD lawyers to get free advice.

How do I make sure I get my full entitlements?

There’s one factor that will ultimately determine whether your TPD claim is successful and how much compensation you receive for your injury or illness – and that’s how well your lawyer gets to know you personally. For many of our clients we’ve made multiple successful claims. Take for example clients who were injured at work and had multiple superannuation funds from various jobs. In these cases, it can be possible to make successful claims for workers compensation, a work injury damages lump sum and multiple TPD insurance claims. Our TPD lawyers will take the time to find out more about you, your family, your work history and all your health issues to claim absolutely everything you’re entitled to.
