What mental illnesses can I claim for?

Any mental health condition or mental illness that prevents you from returning to work may qualify for a TPD claim for mental illness if you developed the illness after your superannuation/ TPD policy commenced. Here are some examples of mental health conditions that could prevent you from working:

  • Post-traumatic stress disorder (PTSD)
  • Persistent anxiety
  • Depression
  • Schizophrenia
  • Bipolar disorder
  • Panic attacks

There’s no defined “list” of conditions that can be used to support a TPD claim for mental illness – the key is that you’ve developed a mental health condition that has stopped you from returning to work.

When my husbands old TPD lawyer said she couldn’t help us anymore and closed our claim, Shane Butcher and Mark Saunders took on his claim and got my husband the money he was entitled to. Law Partners helped us through one of the most difficult times in our lives and we are very grateful.

After an injury that totally removed me from the workforce my future was bleak. I approached several Law companies receiving very little guidance, then I found Law Partners. With my settlement I keep my home and possessions and family intact. I also have good friends for life in the team at Law Partners.

I would like to take this opportunity to express my gratitude to my solicitor and the other Law Partners’ staff who assisted my children and myself since our car accident in 2012. I am certain that any positive and useful result would not have been achieved without your efforts, assistance and dedication to our cases.

Frequently asked questions.

No, it doesn’t matter. Whether your mental health condition or mental illness has been caused by a traumatic event, developed over time or come on suddenly and out of the blue. If it developed after you took out your superannuation / TPD policy, and it has forced you to stop working, then you can lodge a TPD claim for mental illness.

You can make your own claim without using a TPD claim lawyer. However, it’s common for people to have their TPD claims rejected by insurers because they fail to submit a thorough application, including all the documents and medical records needed to substantiate their claims. In other words, many people simply complete the application forms and assume their claim will be approved. But if you do that and fail to supply all the evidence needed to support your claim, it’s likely the insurer will either reject your claim or keep asking you for more information, and the process can really drag on. This is why so many people who handle their own claims end up failing to get the TPD compensation they’re entitled to – they simply give up out of frustration.

A specialist TPD claim lawyer can compile all the evidence and submit your claim on your behalf, so the insurance assessor has all the information they need and you’re more likely to get your TPD claim approved.
