Delivery driver awarded $575,000 from three TPD insurance claims.
Samson wasn’t initially aware he could make a claim for a Total and Permanent Disability (TPD) insurance payout following his debilitating foot injury. But we investigated and uncovered all his entitlements across multiple funds, securing $575,000 for Samson and his family to provide a little more economic certainty as he adjusts to life with a permanent injury.
Sustaining a serious injury while working.
Samson had been working as a delivery truck driver around Sydney’s CBD when he accidently broke his left foot, awkwardly stepping off the back of the vehicle. He expected to be back at work after a recovery period, but the break unfortunately led to a series of complications. Eight surgeries later, Samson was diagnosed with a condition called complex regional pain syndrome.
Complex regional pain syndrome is an ongoing condition that can develop after an injury, but it’s cause isn’t clearly understood. It’s characterised by chronic pain, abnormal inflammation, and nerve dysfunction.
Unfortunately, the condition left Samson in a lot of pain, unable to work, socialise as he once did, or carry out his normal family duties at home. To this day, he can’t wear a sock or shoe on his left foot due to pain and sensitivity.
Samson reached out to Law Partners, and we looked after his workers compensation entitlements. But as time went on, and his condition deteriorated, it became clear that Samson’s days as a delivery truck driver were at an end. He hadn’t been able to work for more than three years, and was having trouble paying all his bills and looking after his family. Because Samson didn’t have qualifications to work in another field, he was seriously worried about his financial future and economic security.

Samson’s legal team at Law Partners explained he would also likely be able to get a TPD payout because his injury was serious and permanent, and he didn’t have qualifications to work in another field. We set to work investigating his insurance policies, and it turned out Samson had TPD insurance with three separate insurance companies.
It’s not commonly known, but if you have more than one TPD policy, you might be able to make multiple TPD claims – one for each policy. This is quite a common situation, as many people have multiple superannuation funds as a result of changing jobs over the years, and may have a TPD policy through each fund.
We gathered all the relevant medical evidence, collected statements from Samson about the impact his injury had on his life, and managed the TPD claims through each of his superannuation companies.
The outcome was a gamechanger, achieving just over $575,000 in total TPD insurance payouts for Samson across his three super funds.
As Samson says, “At a really low point in my life, Law Partners really delivered for me. Jennifer Kyneur and the TPD legal team are experts at getting your TPD claim sorted, so I’d absolutely recommend them to anyone in a similar position to me. I’m a very happy client, to say the least.”
