Rory’s RSL car park injury leads to a CTP payout of $1.2 million.

What started as a simple lunch with a friend turned into a life-changing injury for Rory. But with Law Partners by his side, Rory’s compensation story ended on a positive note with a CTP payout of $1.2 million.

Around midday, Rory had driven to his favourite RSL club to catch up with his best mate over a beer and a burger. Rory parked in the car park as usual, got out of the car, and stood up to spray some deodorant. He then leaned across the driver’s side of his car to the front passenger seat to grab his wallet and phone. Unfortunately, at that exact moment, Rory’s car was hit from behind by another car with enough force to propel Rory’s car 1.5 metres forward.

Rory’s injuries were serious. Both his knees were damaged severely by the unexpected force of impact, along with more minor injuries to Rory’s hip, neck, ribs, and left shoulder. Rory began a process of recovery which included a pain specialist and physio. Feeling incredibly distraught and unable to work, Rory’s mental health also plummeted, and he started seeing a psychologist to help treat his acute depression.

Rory turned to Law Partners for help with financial security and compensation, increasingly uncertain about his recovery prospects and future stability. We got to know Rory personally to build trust and fully understand the impact of the accident on his life. We then set about gathering medical evidence and detailed statements from Rory to help us make a strong case to take to the CTP motor vehicle accident insurance company.

At first, the insurer denied our claim due to the fact Rory had a pre-existing arthritis condition in his knees. However, using medical evidence, we made the case that the accident had accelerated Rory’s degenerative condition in both knees to the extent that he’d needed reconstructive surgery on both knees following the accident, in two separate surgeries.

Rory was also qualified to work as a carpenter, but didn’t have any other vocational training in another field. In the end, the insurance company was persuaded. They conceded that Rory’s injuries were over a 10% threshold, which meant he was entitled to a healthy lump sum payment. We got Rory a substantial CTP insurance payout of $1.2 million in total, covering economic loss and pain and suffering. But in addition, all medical treatment care and expenses will be covered for his lifetime, giving Rory extra peace of mind for the journey ahead.
