The amount you can claim for your stress-related condition depends on your whole person impairment (WPI) assessment. Here’s a summary of entitlements:

Medical expenses | Payment of your medical, hospital, ambulance, rehabilitation (including home help) and travel expenses. |
Permanent impairment payout | A lump sum compensation payout to cover permanent impairment as a result of work-related injury or illness. |
Work Injury Damages payout | Also known as common law claim, this is a lump sum payout for damages if your injury was caused by your employer’s negligence. |
To qualify for a permanent impairment lump sum for a psychological injury, you’ll need to be assessed as having a WPI of 15% or more. You can make a claim without using a WorkCover lawyer. However, every WorkCover claim is different, and it can be hard to know if you’re getting everything you’re entitled to. It’s also common for part or all of a claim to be denied. An experienced WorkCover lawyer will be able to review your claim and make sure you receive your full entitlements.
If you find yourself in a dispute over your claim, having a lawyer on your side will give you a much better chance of success.
For most claims, you’ll receive a liability decision on your claim from WorkSafe within 28 days. If your claim includes a work-related mental injury, your entitlement to provisional payments will be determined within five business days.
Your WorkSafe agent will let you know in writing if your claim has been accepted and the amount of the weekly payments you’re entitled to.
If you’ve made a WorkCover claim, your employer must provide you with suitable or pre-injury employment for a period of 52 weeks. But the 52 weeks isn’t necessarily consecutive as it only includes periods when you have a reduced capacity to work because of your injury.
After this 52-week obligation period, your employer still can’t necessarily terminate your employment, as there are other employment and anti-discrimination obligations your employer must meet.
