What can I claim for a lifting or back injury in Victoria?
The amount of lifting or back injury at work compensation you can claim depends on your whole person impairment (WPI) assessment. Here’s a summary of entitlements:

| Work Injury Damages payout | Also known as common law claim, this is a lump sum payout for damages if your injury was caused by your employer’s negligence. |

Do I need a WorkCover lawyer?
You can make a claim without using a WorkCover lawyer. However, every WorkCover claim is different, and it can be hard to know if you’re getting everything you’re entitled to. It’s also common for part or all of a claim to be denied. An experienced WorkCover lawyer will be able to review your claim and make sure you receive your full entitlements.
If you find yourself in a dispute over your claim, having a lawyer on your side will give you a much better chance of success.
How long does it take to get my compensation?
For most claims, you’ll receive a liability decision on your claim from WorkSafe within 28 days. If your claim includes a work-related mental injury, your entitlement to provisional payments will be determined within five business days.
Your WorkSafe agent will let you know in writing if your claim has been accepted and the amount of the weekly payments you’re entitled to.
Can I be terminated if I make a WorkCover claim?
If you’ve made a WorkCover claim, your employer must provide you with suitable or pre-injury employment for a period of 52 weeks. But the 52 weeks isn’t necessarily consecutive as it only includes periods when you have a reduced capacity to work because of your injury.
After this 52-week obligation period, your employer still can’t necessarily terminate your employment, as there are other employment and anti-discrimination obligations your employer must meet.

Can I claim WorkCover if I'm a casual worker?
Yes, if you’re a casual employee injured at work in Victoria, you’re entitled to claim WorkCover. WorkCover for casual employees is not only limited to citizens and permanent residents. If you’re on a visa that permits you to work in Australia and you’re injured at work, you’re still eligible to claim WorkCover benefits.
