Looking to Claim TPD in Melbourne? Here’s how we can help.

It can be hard to know how much TPD cover you have, as you may have multiple super funds and TPD policies from changing jobs over the years. We’ll review your superannuation statements, identify all your valid TPD policies, and then tell you how much you can claim. This is a free service.

A successful TPD claim needs to be backed by proof that you meet the criteria in your policy. If the insurance assessor decides you don’t meet the criteria, it’s likely your TPD claim will be rejected.

Our specialist TPD lawyers will gather all the evidence and submit your claim on your behalf, so that you can be confident you’ve made the strongest possible case for your claim.

Many claims are delayed or abandoned by people who give up out of frustration caused by delays, as the insurer sends multiple requests for more information.

Our TPD lawyers will prepare your claim thoroughly and professionally, so the insurance assessor has all the information they need to approve your claim without delay.

Claims are often disputed or rejected by insurers on the basis that they don’t meet the criteria in the TPD policy. However, disputes can be caused by missing information and can be overturned by presenting the right evidence.

Our TPD lawyers will uncover all your entitlements across all of your TPD policies and make sure you receive the maximum payouts available.

Common TPD Insurance Claims in Melbourne:

We have extensive experience making successful TPD claims for our clients, covering a wide range of disabilities, injuries, and illnesses, including mental illness.

Disability claims.

If a permanent disability has stopped you from working, you may be eligible to claim a TPD payout through your superannuation.

Critical illness.

Critical or terminal illness  can make it impossible to keep working, but a TPD lump sum claim can ease financial stress during this difficult time.

Physical injury.

Permanent physical injuries often mean you can’t continue in a job suited to your skills, but a TPD payout may be available to provide financial security.

Mental illness.

If a mental illness like depression, anxiety, or PTSD prevents you from working, you may qualify for a TPD insurance payout.

How can I successfully claim TPD insurance in Victoria?

It’s common for people to have their superannuation TPD claims rejected by insurers, or to abandon their claims when the claim process becomes difficult.

It’s important to note that the definition of TPD payout requirements can vary between policies – for example, your policy might cover you for:

  • Being unlikely to be able to return to work in your occupation
  • Being unlikely to be able to return to work in any occupation

A successful TPD claim needs to be backed by proof that you meet the criteria outlined in your TPD insurance policy. If the insurance assessor decides you don’t meet the criteria, your TPD claim will be rejected.

A successful TPD claim needs to be backed by proof that you meet the criteria outlined in your TPD insurance policy. If the insurance assessor decides you don’t meet the criteria, it’s likely your TPD claim will be rejected.

Claims are often rejected on the basis that the applicant doesn’t meet the criteria in the policy. However, in our experience, missing or incomplete information can be a major factor in these rejections.

In our experience, common reasons for insurers rejecting TPD insurance claims include:

  • Not meeting age restrictions
  • A dispute over the evidence provided
  • Not providing evidence that you meet the definition of disability in your policy
  • Lodging your claim too late
  • Your policy becoming inactive – this may be because you closed your account or the account has been inactive for some time
  • Applying before the minimum waiting period
  • Not meeting work history requirements

The time limit to lodge a TPD claim varies depending on the insurer and the specific policy. However, most superannuation policies require a waiting period before you can apply for a TPD benefit, which is typically three to six months from the date you ceased work due to your injury or illness.

In many cases, determining if there’s a time limit to lodge your claim can be difficult, so it’s best to speak with one of our TPD specialists and we’ll advise you about your specific situation, free of charge.

Our TPD lawyers in Victoria have made many successful claims on behalf of our clients, and we have a network of hand-picked medico-legal specialists who work with us to build successful cases. TPD claim stories

Making a TPD claim changed my life.

Shannelle, Trevor and Regina, like so many injured Australians, were completely unaware that they were eligible to make a TPD claim before they contacted Law Partners. Watch the video to find out how a TPD payout changed their lives.

The TPD Superannuation Claims Process in Victoria.

The first step is to identify all your TPD policies and determine if you have a claim. If you have multiple super funds from multiple jobs over the years, you may have multiple TPD policies you can claim against. So we start by gathering your statements and reviewing your TPD cover, and we advise you on what you can claim. This is a free service.

To make a TPD claim, your policy will need to have been valid at the time you became injured or ill. This can be a grey area, as some illnesses and injuries develop over time. We’ll review your TPD policies and the timing of your symptoms to determine which ones are valid.

We’ll read through the terms of your TPD policy (or policies) to understand what qualifies for a lump sum payout. For example, your TPD policy might cover you for:

  • Being unlikely to be able to return to work in your occupation
  • Being unlikely to be able to return to work in any occupation

With some TPD policies in Australia, you don’t necessarily have to be unfit for all work to make a successful TPD claim.

Many people simply complete the application forms and assume their claims will be approved. But if you do that and fail to supply all the evidence needed to support your TPD claim, it’s likely the insurer will either reject your claim or keep asking you for more information, and the process can really drag on. This is why many people who handle their own TPD claims end up failing to get the TPD payout they’re entitled to – they simply give up out of frustration.

Our TPD claim specialists will compile all the evidence and submit your claim for you so that the insurer has all the information they need and you’re more likely to get your TPD claim approved.

This is a key part of a successful TPD claim, but something that’s often overlooked by people who have their TPD claims rejected. A well-written submission will clearly state how your situation satisfies the criteria in your TPD policy.  Our TPD lawyers write hundreds of these submissions every year. When an insurer sees one of our professionally-prepared submissions, they know it’s highly likely to be a valid claim.

Being proactive helps avoid unnecessary delays in making a TPD claim. Insurers won’t necessarily tell you immediately if anything is missing or not filled out correctly. We follow up with the claim assessor to check on the status of your claim and make sure they have everything they need to approve it.

Your Rights and Next Steps:

It’s easy to get started with your claim. Even if you’re not sure what TPD cover you have, we can find out for you. All you need to do is:

  • Gather information.

Find your most recent superannuation statements if you can (or the name of your super funds if you can’t).

  • Call for free advice.

Call 02 9264 4474 and ask to speak to one of our Melbourne TPD lawyers for a free case review.

  • Start your claim.

If you have a valid claim, we can get started on it immediately on a no win, no fee basis.

TPD/Superannuation FAQs:

You can make your own claim without using a TPD claim lawyer. However, it’s common for people to have their TPD claims rejected by insurers because they fail to submit a thorough application, including all the documents and medical records needed to substantiate their claims. In other words, many people simply complete the application forms and assume their claim will be approved. But if you do that and fail to supply all the evidence needed to support your claim, it’s like the insurer will either reject your claim or keep asking you for more information, and the process can really drag on. This is why so many people who handle their own claims end up failing to get the TPD compensation they’re entitled to – they simply give up out of frustration.

Our TPD lawyers can compile all the evidence and submit your claim on your behalf, so the insurance assessor has all the information they need and you’re more likely to get your TPD claim approved.

No win, no fee lawyers offer to run your case for you and only get paid when you win. If you choose the right lawyer, it’s an excellent option that allows you to pursue your claim without any risk, but it’s important to check the lawyer’s costs agreement to fully understand what’s covered.

With some no win no fee lawyers you can still end up having to pay thousands of dollars in disbursements if your case is unsuccessful. This is because their no win no fee agreements cover their professional fees but not the costs they incur.

At Law Partners, our no win no fee, no disbursements guarantee covers all our costs and disbursements as well as our professional fees, so you can pursue your claim with peace of mind.

There’s no complete and defined “list” of common disabilities, injuries or illnesses that qualify you for a TPD claim. The key is that your condition has stopped you from returning to work.

Common examples fall under disability claims (such as blindness or loss of limbs), physical injuries (such as carpal tunnel or paraplegia), critical illness (such as multiple sclerosis or cancer), or mental illness (such as depression or PTSD).

For more examples of TPD claims, take a look at some of our TPD Claims Stories. The examples listed can be used as a general guide. However, you’ll need to check the criteria in your TPD insurance policy to understand exactly what you can claim for.

Yes, if you have more than one TPD policy, you may be able to make multiple TPD claims – one for each policy. This is quite a common situation, as many people have multiple superannuation funds as a result of changing jobs over the years and may have a TPD policy through each fund. Making a successful TPD super claim against one policy has no effect on any other TPD insurance you may have, but you’ll need to submit a separate claim against each policy.

To learn more on this topic, read our blog TPD Payouts – Your Complete Guide.

It usually takes 6-12 months for a TPD claim to be finalised.

Insurance companies generally assess TPD claims within six months. Some straightforward claims are finalised sooner, however with more complicated claims insurance companies often take longer than six months to make a decision.

Once the insurance company has made its decision on a TPD claim, the trustee of the superannuation fund must make their own separate assessment. This process usually takes between one and two months.

TPD payout amounts typically range between $60,000 and $600,000, with many payouts being more than $200,000. The amount you can claim is called your ‘insured benefit amount’, and it will be identified on your superannuation member statement.

TPD policy terms vary, and some policies allow you to retrain and return to work after paying you a lump sum benefit. So, the short answer is – there are some situations where you might return to work after a TPD payout.

A TPD payout is not classed as taxable income, but if you withdraw any part of your TPD payout from your super fund as a lump sum, you may have to pay “superannuation lump sum withdrawal tax”. The amount payable is different for everyone, and if you have multiple super funds, the amount will be different for each fund you make a withdrawal from.

I was in a bad MVA more than two years ago (it was even in the news a few times). Now I can compare Law Partners’ service philosophy to the first law firm that took over my case (which, thank God, I changed), and there is a significant difference: Tanja Maksimovic, Alexander Le Hoang, and Jessica Terre have been realistic, clear, empathetic, communicative, and honest from the beginning… everything you need when you don’t understand legal processes in a different country, with English as a second language, and not even being Australian! The worst setting for feeling vulnerable and lost after the worst experience of your life. I understand that this case will take some time, but I can perceive the team working, progressing, and fighting for me. They keep me updated, I feel legally supported, and I actually look forwards to Alexander’s phone calls… he’s very friendly!

I really appreciate what Tanja and her team have done in taking my case, in supporting me in my difficult times and in encouraging me when I was down emotionally. I wouldn’t be able to go through the claim process without the help of Law Partners.

They’ve gone beyond my expectation. Their effort is greatly appreciated.

First of all I would like to thanks Minaa, Vicky and Sakeena for guiding me through all the process of claim without any hassle. Although my claim was quite bit tough as I don’t have recollection of the accident, they manage to find out all the relevant evidence in order to dispute the insurer decision claiming me as fault. Their advice and guidance throughout the process always make me more comfortable and confidence to get the best possible outcomes. Overall, I am totally satisfied with the outcome of the claim as the claim has been settled with more than my expected amount. All of the team members from Law Partners are cooperative so I wouldn’t hesitate to recommend law partners for anyone needing help with personal injury claims.
