Our client was in hospital for a knee replacement operation. On the day after his operation, the covering doctor didn’t take the time to properly assess his chart when he prescribed a new dose of blood thinning medication. Our client had already taken a dosage of a different drug, and the overlap caused a severe brain bleed.

We claimed for non-economic loss and loss of future income, as well as covering all of our client’s current and future medical expenses. The final settlement amount was $800k.

During labour in hospital our client’s baby’s heart rate dropped to a dangerous level, causing an emergency where the baby had to be delivered as fast as possible. The obstetrician on duty decided to use forceps but didn’t inform our client of the other options available, and the procedure resulted in a grade 3b perineal tear, causing her a devastating and ongoing condition of faecal and urine incontinence.

Our client was awarded $900,000 in medical negligence compensation, made up of payments to address past and future medical treatment expenses, economic loss, pain and suffering including psychological impacts, plus psychiatric therapy and medications.

In this medical negligence claim, our client was injured during a planned termination of a pregnancy. She suffered a perforated bowel caused by the use of forceps, which then required further surgery and treatment over the next two years.

Our claim was successful, and our client was awarded a medical negligence payout of $1.48M.

Many medical negligence payouts in Australia result from delayed diagnosis. Our client went to her doctor with abdominal pain and was incorrectly diagnosed as having an ovarian cyst. She was subsequently admitted to hospital and discharged 24 hours later, once again without a correct diagnosis. She was eventually diagnosed with a ruptured appendix seven days after her initial examination. As a result, she has suffered long-term physical and psychological issues, which could have been avoided if the diagnosis hadn’t been delayed.

Our client was awarded a medical negligence payout of $750k.

Our client presented at hospital with severe neck pain, and the hospital incorrectly diagnosed him as having a muscle strain and simply prescribed pain-relief medication. The next day he returned to the hospital, once again with severe neck pain, however, he was discharged and sent home. On the third day, his limbs stopped working and he collapsed at home and became unresponsive. He was rushed into surgery where it was found he had a cervical spinal epidural abscess caused by a Staph infection. Despite undergoing surgery, the patient was left paraplegic and spent the next four months in hospital.

Our client was awarded a medical negligence payout amount of $4.5M to cover his losses and pain and suffering and to support his future care and treatment expenses.
