What dust diseases can I claim for in Victoria?

No matter how you’ve been injured, we’re here to help you claim your full compensation entitlements.

Asbestosis.

Prolonged exposure to asbestos fibres can cause lung tissue scarring and shortness of breath. Symptoms can range from mild to severe and generally appear many years after initial exposure.

Silicosis.

Silica is a substance naturally found in certain types of stone, rock, sand and clay. Silicosis is a lung disease caused by inhaling large amounts of crystalline silica dust, usually over many years working with these materials.

Mesothelioma.

Mesothelioma is a type of cancer that develops in the lining that covers the outer surface of some of the body’s organs. It’s usually linked to asbestos exposure. Even brief exposure to asbestos can lead to Mesothelioma.

Pneumoconiosis and Black Lung Disease.

Pneumoconiosis refers to a group of lung diseases caused by dust in the lungs. With coal workers it’s commonly known as “black lung disease”, and is caused by inhaling coal dust over long periods of time.

What can I claim in Victoria?

If you’ve developed a dust disease, the compensation options open to you depend on what you were exposed to and the circumstances. Here are some examples of entitlements for asbestos-related diseases in Victoria:

Circumstances of Exposure Entitlements
At work

Medical expenses, pension and other benefits (statutory compensation), and lump sum compensation in certain circumstances via WorkSafe Victoria.

As a commonwealth employee

In the defence forces

A pension and payment of medical expenses under the Veterans Entitlements Act.

Outside work

Compensation claim against the product manufacturer or location where exposure occurred via the County Court of Victoria or the Supreme Court of Victoria, depending on the complexity and severity of the case.

Our dust disease lawyers will take time to listen to your story, understand how you’ve been impacted and explain everything you’re entitled to claim.

Frequently asked questions.

Since exposure to hazards like asbestos generally occurs long before related diseases develop, it might seem hard to pinpoint exactly where and when you were exposed.

But we can help. Our specialist Victorian dust disease and asbestos lawyers will work with you to identify any potential exposure, including:

  • Living in close proximity to industrial sites
  • Work-related exposure to asbestos, silica or other dusts
  • Being in a home that contained asbestos during renovations
  • Working with asbestos, or being around someone who was working with asbestos

Your Victorian Law Partners legal team will investigate and thoroughly document all the required evidence on your behalf.

Asbestos-related diseases can take many years to develop. No matter how long ago you were exposed to asbestos, you may still have a valid claim for compensation, and compensation amounts can be significant. There’s no cost to speak to one of our asbestos lawyers and discuss your situation.

Yes, there have been many cases of successful compensation claims for asbestos-related illnesses such as mesothelioma on behalf of people who have lived with someone who worked with asbestos. Asbestos fibres can be brought into the home on clothing, skin and in hair, leaving family members exposed. If you believe you’ve been exposed to asbestos in this way, you may have a valid claim.

No win no fee lawyers offer to run your case for you and only get paid when you win. If you choose the right lawyer, it’s an excellent option that allows you to pursue your claim without any risk, but it’s important to check the lawyer’s costs agreement to fully understand what’s covered. With some no win no fee lawyers you can still end up having to pay thousands of dollars in disbursements if your case is unsuccessful. This is because their no win no fee agreements cover their professional fees but not the costs they incur. At Law Partners, our no win no fee, no disbursements guarantee covers all our costs and disbursements as well as our professional fees, so you can pursue your claim with peace of mind.

I lodged a complaint about bullying in the workplace. 78 pages of incidents I recorded, was deemed no evidence of bullying after investigations by the Insurance company. What a blessing for me to find Bianca Azzopardi to appeal the decision. Her professionalism, her fight for justice for me. With her help, the case is won. I sustained personal injury as a result of bullying and at the Personal Injury Tribunal, my ex employer is deemed the party that is wrong and the Tribunal ordered them to pay for compensation.

It was a very stressful time for me, and Bianca handled my case very professional and in the best of my interest . I can communicate with her any time. She replied promptly. She gives clear instructions.
During that very ‘dark’ time, when my ex-employer and the Insurance Company for Worker’s Comp denied bullying, I cannot describe to you how it feels hearing Bianca’s caring and reassuring voice, to send her my file of complaint and she will look after me.

Thank you Bianca, thank you for walking this journey with me.
I highly recommend Bianca.

I was shocked when my initial assessment came back as minor but I was too overwhelmed at the time to dispute it. Something in my gut told me to get a second opinion and I’m so relieved I did. I almost missed out of a lump sum payment which has helped so much with my recovery.

Very satisfied with the outcome of my claim. Gillian, Melissa and all staff I dealt during my case were professional and caring and did an amazing job dealing with an insurance company to get me a fair compensation payout. So glad I chose Law Partners as otherwise, I would have given up in frustration and not been compensated for time lost at work due to someone else’s negligence. Recommend them highly.

I am lucky enough to have Angy Basal and Georgia McPherson on my side all the way through to my worker compensation claim. Since they took over my case, I never worried about legal side. Very professional and very easy to reach and understand a situation really well and finally they have won a legal battle with my insurer.

I will highly recommend Law Partners to those who are struggling with legal battles with insurance or with their employer. Thanks very much for treating me with dignity and respect.
