Silica dust exposure: is history repeating itself?
Australia is facing a growing health crisis, one that echoes the devastating legacy of asbestos. Silica dust exposure, particularly in construction and infrastructure projects, is emerging as a serious threat to workers’ health, and the parallels to asbestos-related disease are striking.

The three waves of asbestos, and a new wave of silica.
Historically, asbestos exposure in Australia unfolded in three waves:
- Mining and processing – of raw asbestos in WA and NSW from the 1880s.
- Tradespeople – such as plumbers, electricians, boilermakers across the 20th century handling asbestos-containing materials in construction, rail, and shipbuilding.
- The general public – who unfortunately became exposed as aging infrastructure deteriorated and released asbestos fibres into the air.
Now, we’re seeing similar patterns with silica dust. Recent reports from major government projects like Metro West and Metro City & Southwest in just Sydney alone reveal alarming statistics:
- 1 in 3 air quality tests during Metro City & Southwest construction exceeded the Workplace Exposure Standard (WES), some by over 200 times.
- 1 in 7 tests at Metro West sites showed toxic silica dust levels above the WES.
These levels are significantly higher than those found in engineered stone benchtops, products that have now been banned in NSW due to their health risks. If benchtops warranted legislative action, what does that say about tunnel projects with even greater exposure?
What is silicosis and why is it so dangerous?
Silicosis is a lung disease caused by inhaling fine silica particles. Unlike asbestos-related illnesses, which can take decades to develop, silicosis can appear in just a few years. At Law Partners, we’re already supporting clients in their 20s who are struggling to breathe after only five years of exposure.
Silica particles lodge in the lungs, making it difficult to exhale. Over time, this can lead to chronic respiratory issues and even cancer. It’s a painful, suffocating condition, and tragically, it’s affecting more Australians every year.
Legal action and the role of the dust diseases tribunal.
Just as asbestos led to landmark litigation against companies like James Hardie and CSR, silica dust exposure is likely to result in a wave of legal claims. The Dust Diseases Tribunal (DDT) in NSW has already created a dedicated silicosis list to manage the growing number of cases.
Here at Law Partners, our team led by dust disease specialist and associate lawyer Dean Pefani, is deeply experienced in dust disease litigation. We understand the legal pathways, the medical complexities, and the urgency of acting quickly, especially for clients with a confirmed diagnosis.
Understanding your rights: the three key pathways.
So, what does this all mean for you? Whether you’ve been diagnosed, recently exposed, or lost a loved one to a dust disease, you may have legal options. Here’s how we typically approach these cases:
Confirmed diagnosis.
If you’ve been formally diagnosed with a dust disease listed under Schedule 1 of the Workers Compensation (Dust Diseases) Act 1942 (NSW), you’re entitled to both statutory and common law benefits. These diseases include:
- Silicosis
- Asbestosis
- Mesothelioma
- Pneumoconiosis
- And many more
We act swiftly to file and resolve your claim, ensuring you receive the support yo
Recent exposure without diagnosis.
Even if you haven’t been diagnosed yet, we can help. Dust diseases often have a latency period, and early registration allows us to act quickly if symptoms develop later.
We can also support clients experiencing psychological distress due to exposure. If anxiety or depression arises, we can file a separate workers’ compensation claim while keeping the dust disease matter on hold.
Claims after a death.
If a loved one has passed away from a dust disease, you may be able to file a claim on behalf of their estate or as a dependent. These cases can be complex, but we’re here to guide you through every step.
